### **LFG Merchant Details & Trading Name (DBA) Policy**

### 1 Objective

Layer Flow Gateway (LFG) is dedicated to facilitating trusted, secure, and transparent crypto-to-fiat commerce. This policy outlines the mandatory requirements for the names and addresses merchants use when processing payments through our infrastructure. Our goal is to ensure clarity for LFG, our liquidity providers, regulatory bodies, and the end consumers.

### 2 Business Details Definition

During the onboarding process, all business customers must provide two distinct sets of information:

Incorporated Details: The legal entity name and registered office address as officially listed on government-issued incorporation documents.

Trading Details (DBA): The ‘Doing Business As’ name and physical operating address that consumers recognize and will see on their digital receipts or payment interfaces.

### 3 Acceptable Use of Trading Names (DBA)

LFG recognizes that in many legitimate global business models (e.g., authorized dealerships in the UAE or franchises in the EU), a merchant’s trading name may differ significantly from their incorporated identity. We support the use of DBAs provided that:

Ownership: The name is legitimate and belongs to the merchant or their parent company.

IP Compliance: The name does not violate third-party trademarks or intellectual property rights.

Authorization: In the case of authorized dealerships or franchise agreements (e.g., Al Nabooda trading as Porsche Centre Dubai), the merchant must be able to provide proof of authorization to trade under that brand name immediately upon request.

### 4 Prohibited Uses ("The Brand Hijacking Rule")

Merchants are strictly prohibited from using trading names or addresses that:

Mislead Consumers: You may not claim to be, or impersonate, a well-known brand (e.g., Nike, Apple, Coca-Cola, etc.) if your business is unrelated or unauthorized.

Facilitate Fraud: Any attempt to use a trading name to obscure the nature of goods sold or to deceive the sender of funds is prohibited.

Are Offensive: Names that are politically, socially, or ethically offensive will be rejected.

### 5 Operational Addresses

If your physical place of business differs from your registered office, you must provide the operational address. This must be a verified physical location used by the business; P.O. Boxes or mail-forwarding virtual offices are not permitted for operational address entries.

### 6 Disclaimer: LFG Verification & Liability

By submitting trading details that differ from your incorporated data, you acknowledge the following:

#### 6.1 No Initial Verification:

LFG (Layer Flow Gateway) provides the technical infrastructure and does not verify the initial accuracy, trademark ownership, or legitimacy of the trading details you submit.

#### 6.2 Merchant Responsibility:

You are solely responsible for ensuring you have the legal right to use your chosen trading name (DBA).

### 7 Account Suspension & Legal Recourse

LFG maintains a zero-tolerance policy for brand hijacking and identity fraud. If a merchant is found to be in breach of these guidelines:

#### 7.1 Termination of Access:

LFG will immediately terminate or suspend your account and API access without prior notice. As a non-custodial provider, this action will permanently disable your ability to process new payments or access integrated off-ramping/settlement services through our partners.

#### 7.2 Reporting to Authorities:

LFG reserves the right to report suspected fraudulent activity, brand hijacking, or identity theft to the relevant financial and law enforcement authorities in the merchant’s country of incorporation and the regions in which they operate.

#### 7.3 Indemnification & Legal Costs:

The merchant agrees to indemnify LFG against any third-party claims arising from a breach of this policy. LFG reserves the right to pursue the merchant for all legal costs, regulatory fines, or damages incurred by LFG as a result of the merchant’s unauthorized or fraudulent use of trading names.

#### 7.4 Jurisdictional Compliance:

LFG will cooperate fully with any legal actions or information requests required by the laws of the merchant’s country of incorporation.
